HEARING

In the fall of 2009, when the Niagara Escarpment Commission (NEC) turned down the Walker application, we expected to face an expensive and complicated hearing which was scheduled to last for 10 weeks. We were also faced with the daunting task of opposing, not only the proponent Walker, but also, Simcoe County and Clearview Township whose legal and expert fees were paid by Walker to appear at the hearing in support of the application. (See the Settlement Agreements linked on the sidebar). After a long prehearing process, the hearing began on May 3, 2010, and the oral evidence finally came to a close in June, 2011, fourteen months later. The hearing adjourned for the preparation of an extensive written final argument which was completed in early August.

Experts for the Parties opposed to the Walker Application to locate a new and larger quarry on the Niagara Escarpment, west of Duntroon gave strong evidence to support the case in opposition to the Walker Application. The Niagara Escarpment Commission, the Clearview Community Coalition (CCC) and Emelia Franks brought experts in hydrogeology, natural heritage, visual, noise and land use planning before the Hearing Panel. A Harts Tongue Fern specialist from the University of Michigan and the Environmental Commissioner of Ontario also testified in support of the CCC case. Several Lay Witnesses and Participants submitted witness statements and testified before the Hearing Panel to present their concerns with the Walker proposal to locate a new and larger quarry on the Niagara Escarpment.

The hearing officers are presently considering hundreds of hours of testimony and volumes of evidence as they consider their decision.

The support, encouragement and countless volunteer hours by people who care about the Niagara Escarpment and the future of our community has taken CCC a long way over many months; the end is in sight, please help us through the final lap! Our involvement as a Party in the OMB/ERT (Ontario Municipal Board/Environmental Review Tribunal) process has cost far more than we ever could have imagined. But we believe it’s a fight worth fighting.
